MyColoringBook.io is an AI-powered platform that converts uploaded photographs into coloring book pages using artificial intelligence technology. Our Service allows users to upload photos, generate coloring book pages, and share their creations.

3. Eligibility and Account Registration

• Age Requirements: You must be at least 13 years old to use our Service. Users under 18 must have parental or guardian consent.
• Account Creation: You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities under your account.
• Geographic Restrictions: Our Service is currently available only in the United States. We reserve the right to restrict access from other jurisdictions.

4. Credit System and Payments

• Credits: Our Service operates on a credit-based system. Credits are required to generate coloring book pages and must be purchased in advance.
• Credit Expiration: All credits expire 90 days from the date of purchase. Expired credits cannot be restored or refunded.
• Pricing: Credit pricing and generation costs are displayed on our website and may change with 30 days' notice.
• Payment Processing: All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service.
• No Automatic Renewal: Credits do not automatically renew. You must manually purchase additional credits when needed.

5. Content and Usage Rights

• Your Content: You retain ownership of all photos you upload to our Service. You represent that you have all necessary rights to upload and use the photos you submit.
• Generated Content: You own the coloring book pages generated from your photos, subject to these Terms.
• Content Restrictions: You may not upload content that:
  • Violates applicable laws or regulations
  • Infringes on third-party intellectual property rights
  • Contains nudity, violence, or other inappropriate material
  • Violates OpenAI's Usage Policies or Google's Prohibited Use Policy (incorporated by reference)
• Content Moderation: We reserve the right to review and remove content that violates these Terms or applicable policies.

6. Third-Party Services

Our Service integrates with third-party providers, including:

• OpenAI: For AI image generation (subject to OpenAI's Terms of Use and Privacy Policy)
• Google Gemini: For potential future AI services (subject to Google's Gemini API Terms)
• Stripe: For payment processing (subject to Stripe's Terms of Service)
• Supabase: For data storage and authentication
• Vercel: For analytics and hosting

By using our Service, you acknowledge and agree to be bound by the applicable terms of these third-party providers.

7. Data Retention and Deletion

• Photo Storage: Your uploaded photos and generated coloring book pages are stored securely in our system.
• Content Deletion:
  • You may request deletion of your content at any time
  • Deleted content is hidden immediately but retained for 30 days before permanent deletion
  • After 30 days, all content is permanently deleted and cannot be recovered
  • We automatically delete content after extended periods of account inactivity
• Account Deletion: You may request account deletion by emailing delete@mycoloringbook.io.

8. Sharing and Social Features

You may share your generated coloring book pages through our social sharing features. Shared content becomes publicly accessible through the shared links you create.

9. Prohibited Uses

You may not:

• Use our Service for any illegal purposes
• Attempt to reverse engineer or replicate our AI technology
• Upload content you do not own or have rights to use
• Circumvent our content moderation systems
• Create multiple accounts to abuse our credit system
• Use automated systems to generate content at scale

10. Intellectual Property

• Our Rights: We retain all rights to our Service, technology, trademarks, and proprietary algorithms.
• DMCA: We respond to valid DMCA takedown notices. To report copyright infringement, contact us at help@mycoloringbook.io.

11. Disclaimers and Limitations

• Service Availability: Our Service is provided "as is" without warranties. We do not guarantee uninterrupted access or error-free operation.
• AI-Generated Content: AI-generated coloring book pages may not always accurately represent the original photos. You should review all generated content before use.
• Limitation of Liability: Our total liability to you is limited to the amount you paid for credits in the 12 months preceding any claim, not to exceed $100.

12. Indemnification

You agree to indemnify and hold us harmless from any claims arising from your use of our Service, violation of these Terms, or infringement of third-party rights.

13. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time by contacting us.

14. Changes to Terms

We may update these Terms with 30 days' notice for material changes. Continued use constitutes acceptance of updated Terms.

15. Governing Law and Disputes

These Terms are governed by Tennessee law. Any disputes will be resolved in the courts of Davidson County, Tennessee.
